Masterclass Series on Healthcare Law and Policy

The Masterclass Series is hosted by the Mandela Institute, Wits School of Law, in partnership with the South African Association for Bioethics and Health Law. This series features four expert-led sessions aimed at enhancing understanding of key issues in healthcare law.

Masterclass 3: Pharmaceutical and Medical Device Regulation

Join us for a discussion on pharmaceutical and medical device regulation. This masterclass will explore the following key aspects:

  • Overview of Health Products (medicines and complementary medicines)
  • The regulatory regimes of SAHPRA and the Pharmacy Council, as well as specific offenses
  • Scheduling of medicines and devices, as well as marketing and promotion of medicines and medical devices
  • Medical Scheme Formularies:
    • Their necessity
    • How are formularies actually negotiated/structured
    • Open and closed formularies
    • Permissible vs non-permissible formularies and related conduct
  • Single Exit Pricing

Presenters:

Val Beaumont is a pharmacist by profession, who also holds an M.Pharm (Industrial Pharmacy) and an MSc. Med (Bioethics and Health Law). Val is the Executive Officer of the Marketing Code Authority, a self-regulatory body established by the pharmaceutical industry in South Africa, to govern and adjudicate on disputes relating to marketing and promotional activity of medicines.

Inez Naidu is a pharmacist who heads the medicine unit at Discovery Health (Pty) Ltd, responsible for managed healthcare pharmacy strategy, medicine risk management and pharmaceutical stakeholder engagement. She holds B Pharm and M Pharm (Clinical Hospital Pharmacy) degrees from Wits and has over 25 years of healthcare industry experience.

Julie Oppenheim is a partner in the Corporate and Commercial team at Bowmans and is the head of the Pharmaceutical and Healthcare sector Group. Julie specialises in mergers and acquisitions, restructurings and corporate and commercial law with a specific focus on companies operating in the pharmaceutical and healthcare industry. She also regularly advises on pharmaceutical and healthcare regulatory matters such as medicine pricing (including in relation to the single exit price, logistics fees, data fees and other fees), the supply and distribution of, and the marketing and advertising of, medicines, medical devices and complementary medicines, clinical trials, patient support programmes, technology applications in the healthcare space and related matters.

Facilitated by Daven Dass a Senior Lecturer in the School of Law at the University of Witwatersrand, he is also the President of the South African University Law Clinic Association and former Director of the Wits Law Clinic, where he still continues his practice as a supervising attorney of the General Unit.
